“Force majeure” means events beyond reasonable control, such as:

• natural disasters,

• war,

• pandemics,

• government restrictions.

In such situations:

• Neither the landlord nor HomeInZagreb is liable for non-performance caused by these events.

• Any refunds are not guaranteed and are entirely discretionary.

• If any refunds are given, they may include only unused portions of rent and never include the service fee (service fees remain non-refundable).

How long do I have to move out after termination?

Once the lease is terminated (by you or the landlord):

• You must vacate the property within 7 days of written notice,

• unless a different move-out deadline is mutually agreed in writing.

Failing to move out within this period can lead to further legal consequences and costs.

The landlord may terminate the lease and retain your deposit if:

• rent or utilities are more than 15 days overdue,

• you breach any provision of the contract, or

• you use the property unlawfully, for an unauthorized purpose, or in a way that is contrary to the agreed use of the property under the contract, including failing to keep the property reasonably clean, causing mold, or causing damage to the property, furniture, equipment, or appliances.

In such cases, the landlord may both:

• terminate the lease, and

• retain your deposit.

If you, the tenant, terminate the lease before its expiration:

• The deposit is fully forfeited to the landlord (you lose 100% of it).

• You may remain liable for rent during:

  • the notice period, or

  • the full fixed term,
    unless a replacement tenant acceptable to both the landlord and HomeInZagreb is found.

• Any unpaid utilities or damages:

  • will be deducted from the deposit, or

  • invoiced separately if the deposit is not enough.

If you report issues after 24 hours from move-in:

• Any matters related to cancellation and refund are then governed only by the Lease Agreement.

• HomeInZagreb has no refund or liability obligations in relation to cancellation.

You can still communicate with the landlord and HomeInZagreb, but the special “material non-conformity” protection no longer applies after the first 24 hours.

“Material non-conformity” means that, when you move in, the actual property is significantly and seriously different from what was agreed and advertised – for example:

• the property is uninhabitable

• there are serious safety hazards.

If this happens:

1. You must report it within 24 hours of move-in.

2. You must provide photo or video evidence clearly showing the problem.

3. HomeInZagreb and the Landlord will review your claim together.

If your claim is verified and accepted, you may:

• be relocated to equivalent accommodation, or

• receive a partial refund of up to 50% of the deposit, depending on:

  • the situation, and

  • the number of days you have stayed.

Generally, no.

After move-in:

• There are no refunds of the deposit or service fee under any circumstances, except in the specific case of “material non-conformity” reported within 24 hours

If you cancel less than 14 days before your move-in date:

• No refund of any kind will be provided:

  • no refund of the service fee, and

  • no refund of the deposit.

The landlord and HomeInZagreb may, at their sole discretion, offer a partial refund only in proven cases of force majeure, such as:

• serious illness,

• border closure,

• natural disaster,

and only if supported by official documents. This is not guaranteed; it is purely discretionary.

If you cancel after 48 hours from the initial payment (and before move-in):

• The service fee is strictly non-refundable.

• The deposit is non-refundable, unless a replacement tenant is found and approved by both:

  • the Landlord, and

  • HomeInZagreb.

If such a replacement tenant is approved for the same rental term and conditions:

• 100% of the deposit is refunded,

• minus a €50 administrative fee for coordination and transaction costs.

So after 48 hours, the only way to get your deposit back is to have a suitable replacement tenant formally approved.

If you cancel in writing within 48 hours of your initial payment (service fee or deposit):

• You receive a full refund of what you paid,

• minus a €50 administrative fee to cover coordination and transaction costs.

This is the only period where both the service fee and deposit are almost fully refundable.
