Only the tenants named in the contract are allowed to live in the apartment. If the landlord discovers that other people are living there, they may increase the rent or terminate the agreement.

You may not sublet the apartment, or any part of it, to another person without the landlord’s prior written consent.

You must also inform the landlord about any person who is not listed in the agreement and stays in the apartment for more than 24 hours or uses it for overnight stays.

You must:

• keep the apartment clean and orderly,

• use it with the care of a good tenant,

• pay for small, regular maintenance items (for example, light bulbs),

• promptly inform the landlord about any serious defects or problems with major appliances.

The landlord usually pays for repairs of major appliances and infrastructure, unless the damage is caused by your negligence or improper use. In that case, you must cover the costs.

If you do not maintain the apartment properly, the landlord may:

• hire a cleaning service at your expense, and

• in serious cases, terminate the contract.

If urgent damage needs immediate repair and you are responsible, the landlord can:

• order the work,

• ask you to repay the costs, and

• terminate the agreement without returning the deposit if you refuse to cooperate or pay.

When the tenancy ends, you must:

• remove all your personal belongings, and

• return the apartment in the same condition as at move-in, considering normal wear and tear.

The landlord will:

• inspect the apartment,

• document the final condition and meter readings, and

• calculate any necessary repairs or extra cleaning.

If the cost of returning the apartment to the move-in condition is higher than the deposit, the landlord can charge you the difference and provide a list of those costs.

At the beginning of the tenancy, the landlord must hand over the apartment:

• clean, tidy and habitable,

• with working appliances and basic equipment needed for normal living.

The landlord is not obliged to provide consumables or extra items such as cleaning products, toilet paper, full kitchenware, fancy tools, etc.

After you move in, you have 48 hours to:

• check the apartment and appliances,

• report any defects or issues to the landlord, and

• together with the landlord, document the condition of the apartment and the initial meter readings for water, gas and electricity (usually with photos).

This documentation is very important for comparing the condition at move-in and at move-out.

The security deposit (amount shown in the Basic Terms) is paid as a guarantee that you will:

• pay rent and utilities, and

• take care of the apartment and follow the contract.

At the end of the tenancy, the landlord returns the deposit within a reasonable time, but can legally:

• wait for final utility bills and

• check and repair any damage before returning it.

The landlord can keep all or part of the deposit if:

• you terminate the contract early,

• you owe rent or utilities, or

• there is damage or cleaning needed beyond normal wear and tear.

The deposit cannot be used as rent or utilities during the contract, unless the landlord and tenant make an exceptional, written agreement for the last month’s utilities.

Besides rent, you must pay all utility costs related to the apartment during your stay, such as:

• electricity, water, gas,

• garbage collection,

• TV and internet subscriptions,

• building common area charges and similar items.

Depending on your agreement, utilities can be:

• paid by actual consumption, based on invoices or calculations the landlord shows you, usually by the 15th of the following month, or

• charged as a fixed monthly amount, paid together with the rent.

If utilities are fixed but your consumption is very high or prices rise significantly, the landlord can charge extra for the difference or increase the fixed amount.

If you are more than 15 days late paying utilities or related costs, the landlord may:

• charge default interest, and

• terminate the contract and keep the deposit.

The monthly rent amount is written in the Basic Terms and repeated in the rent article. There is also a payment schedule table that shows:

• which rental period each payment covers, and

• the exact due date for each month (for example, rent for January due on January 1).

Rent is paid directly to the landlord, using the bank account listed in the contract. If the rent is not paid on time, the landlord can:

• charge statutory default interest for every day of delay, and

• if you are more than 15 days late, terminate the agreement and keep the deposit.

In some cases, landlord and tenant may agree on a different payment arrangement only for the first and last month, but this must be mutual and in line with the contract.

The agreement clearly describes:

• the address of the property,

• the type of unit (for example, apartment with a certain number of rooms), and

• the rooms and spaces included (e.g., bedrooms, kitchen, bathroom, hallway, balcony).

You may use the property only for living (residential use) and must follow the house rules of the building.

The contract is between:

• the landlord, whose name, address, OIB, bank account and contact email are listed in the Basic Terms; and

• the tenant or tenants, whose names, addresses and ID or passport numbers are also listed in the Basic Terms.

If there are multiple tenants in the same apartment, they are jointly and severally liable, which means each tenant is responsible for the full rent and all costs, not just “their share”.

The Tenancy Agreement is the legal contract between you (tenant) and the landlord. It defines the property, rent, deposit, utilities, rules, and what happens at move-in, during the stay, and at move-out.

It is signed for a fixed period (for example, from January 1 to December 31) and the rights and obligations start on the day both parties sign the agreement.
